By accessing https://picoviyan.com or using any of PicOviyan's services, you confirm that you are at least 18 years of age and agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

These terms apply to all visitors, clients, and users of our website and services.

PicOviyan provides professional photo editing services including, but not limited to:

• Photo Retouching (skin smoothing, blemish removal, beauty enhancement)
• Background Removal and Replacement
• Color Correction and Grading
• Clipping Path
• Ghost Mannequin / Invisible Mannequin Effect
• Shadow and Reflection Creation

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

Orders are initiated by submitting a quote request through our website. An order is confirmed only when:

• You have received a written quote from us via email, and
• You have accepted the quote and provided your images for editing.

You are responsible for providing accurate project requirements. Significant changes to the scope of work after an order is confirmed may result in revised pricing and timelines, which we will communicate to you before proceeding.

Payment terms will be outlined in the quote provided to you. Unless otherwise agreed in writing:

• Payment is due upon delivery of the final edited files, or as specified in your project agreement.
• For larger projects, we may require a deposit before work begins, as stated in your quote.
• Overdue payments may result in suspension of services and withholding of deliverables until payment is received.

All prices are quoted in USD unless otherwise specified. You are responsible for any applicable taxes or transaction fees imposed by your payment provider.

We aim to deliver completed work within 24 hours of receiving your images and confirmed requirements for standard projects. Turnaround times for larger or more complex projects will be agreed upon individually in your quote.

Delivery timelines are estimates and not guaranteed. We are not liable for delays caused by factors outside our control, including but not limited to technical failures, incomplete project briefs, or delayed responses from you.

Edited files will be delivered via the method agreed upon (e.g., cloud storage link, email, or our platform).

We offer one free revision per project. A revision is defined as adjustments within the original agreed-upon scope of work.

• Revision requests must be submitted within 7 days of receiving your edited files.
• Additional revisions or changes outside the original scope may be subject to additional fees, which will be quoted before work begins.
• We will make every effort to match your vision; however, subjective artistic preferences that deviate significantly from the original brief may not be covered under the free revision.

You retain full ownership of all images and files you submit to us. By submitting images, you represent and warrant that:

• You own the images or have the legal right and necessary permissions to submit them for editing.
• The images do not violate any third-party intellectual property rights, privacy rights, or applicable laws.
• You have obtained any required model releases or property releases for images depicting identifiable people or private property.

You grant PicOviyan a limited, non-exclusive license to use your images solely for the purpose of providing the editing services you have requested. This license terminates upon completion and delivery of your project.

All content on the PicOviyan website — including our logo, design, copy, and software — is the property of PicOviyan and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without our explicit written permission.

Editing techniques, workflows, and tools developed by PicOviyan remain our proprietary intellectual property.

You agree not to submit images or request editing that involves:

• Content that is illegal, obscene, defamatory, or harmful.
• Images depicting minors in any inappropriate context.
• Content intended to deceive, defraud, or harm others.
• Material that infringes on the intellectual property or privacy rights of any third party.

We reserve the right to refuse or cancel any order at our sole discretion if we determine that the submitted content violates these terms or our values.

PicOviyan strives to deliver high-quality editing services. However, our services are provided "as is" and "as available" without warranties of any kind, either express or implied, except as required by law.

We do not warrant that our services will be uninterrupted, error-free, or that results will meet every subjective expectation. Results may vary based on the quality and resolution of your source images.

To the fullest extent permitted by applicable law, PicOviyan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Loss of profits, revenue, or business opportunities.
• Loss of data or files.
• Delays in delivery.

Our total cumulative liability to you for any claim arising out of or related to these terms or our services shall not exceed the amount you paid to us for the specific project giving rise to the claim.

You agree to indemnify and hold harmless PicOviyan and its team members from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your breach of these Terms of Service.
• Your submitted content or your use of our deliverables.
• Your violation of any applicable law or third-party rights.

Either party may terminate a project or engagement at any time by providing written notice. If you cancel a project:

• Any deposit paid is non-refundable if work has already commenced.
• You will be invoiced for work completed up to the point of cancellation.

We reserve the right to terminate service to any client who violates these terms, without refund for incomplete work where the violation caused the termination.

These Terms of Service shall be governed by and construed in accordance with applicable law. As a remote-first global service, we will make reasonable efforts to resolve disputes amicably. In the event of a formal dispute, both parties agree to attempt mediation before pursuing litigation.

We may update these Terms of Service from time to time. The "Last updated" date at the top of this page reflects when the most recent changes were made. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.

For significant changes, we will make reasonable efforts to notify you via email if you are an existing client.
